關注組與荃灣葵青地政署會議後之跟進

你二○○九年十二月二十九日的電郵及二○一○年一月一日來信收悉。

本處人員於二○○九年十一月九日發現違反該地段的契約條件的情況後,隨即聯絡業主要求有關停車場的註冊業主糾正違規事項,並其後於二○○九年十一月十六日發出信件跟進。該地段業權人回覆本處,表示已安排終止有關停車場合約,並於二○○九年十二月三十一日生效。業權人表示,將於二○○九年十二月三十一日前糾正違規情況。本處人員於二○一○年一月四日進行視察時,發現華景山莊停車場內沒有存放上述沒有牌照的左軚車輛。

儘管如此,本處就該違規反地契事項向業權人追收費用,業權人已清繳有關費
用。

至於你在二○一○年一月八日在本處商討有關事宜時指出現時仍有沒有牌照的左軚車輛存放於華景山莊,本處會盡快進行調查。若發現有違規情況,會考慮採取執行契約行動。

Thank you for your speedy reply to acknowledge receipt of both our letters.

We sincerely hope that you can give us a clean and clear answer to our concerns regarding The Registered Owner’s application to change the land use of the 3 car parks in Wonderland Villas. Is this a violation of Outline Zoning Plan? Could the Registered Owner change the use of a domestic zoning estate for commercial lease of vehicles storage by paying a substantial amount without the consent of the residents of that estate?

I refer the recent correspondence between you and this office.

You are asking if the change of the land use of the concerned carparks represents a violation of Outline Zoning Plan. In this relation, please be advised that under the draft Kwai Chung Outline Zoning Plan no. S/KC/23, temporary uses (expected to be 5 years or less) are always permitted as long as they comply with any other relevant legislation, the conditions of the Government lease concerned and any other Government requirements.

We have explained during the meeting on 8.1.2010 that more than 6 months would be required to complete the whole lease enforcement action. In light of this plus the owners indication that the breach would be rectified by 31.12.2009, it is considered more pragmatic and effective to secure cessation of the vehicles storage on the Premises on 31.12.2009 by binding the owners in writing.

Inspections by our staff on 4.1.2010 and 11.1.2010 did not reveal any recurrence of vehicle storage on the Premises. Furthermore, please also be advised that this office has not received any application from the owners for recurring the vehicles storage.

Attached please find the self-explanatory correspondences between our Focus Group and your Tsuen Wan Office.

Could you kindly clarify: has the Registered Owner( Sun Hung Kai Properties) applied to change the usage of the car parks in Wonderland Villas from solely residential use to commercial use to be leased out for massive amount of vehicle storage at your office?

The about act is the worst nightmare to majority of our residents in Wonderland Villas. Kindly advise how we may stop this evil act that is hazardous to our health.

Thank you for your prompt reply.

Kindly help us to understand: is it correct that no matter which Lands Dept office the subject application might be filed, it would automatically be referred to the Tsuen Wan Office; thus, it is not necessary to send inquiry to other Lands Dept office?

The Focus Group may seemed overly cautious and suspicious, for the trust between the domestic owners of Wonderland Villas Estate and the Register Owner (Sun Hung Kai) was totally ruined by the Register Owner itself by its repeated dishonest track records in the past 10+ years.
